Fourth Circuit’s ruling in anti-Asian Discrimination case sets a dangerous precedent

The US Court of Appeals for Fourth Circuit ruled today that a lawsuit filed against anti-Asian admissions discrimination at Thomas Jefferson High School for Science and Technology in Fairfax County (referred to as “TJ”) was rejected by a 2-1 split decision. TJ is a select public school located in Fairfax County. TJ implemented a new policy in 2020 that was racially neutral, but actually aimed to reduce the number of Asian-Americans accepted to the school. This would allow the school to have a more representative student body, closer to Fairfax County’s demographics. Federal district Judge Claude Hilton ruled in favor of the new policy because it was intended to promote racial balancing and also motivated out of hostility towards Asians.

Fourth Circuit reverses district court decision today (wrongly in my opinion), but in a way which sets a precedent dangerous that could allow government policies to discriminate against various minorities.
