You can bet on the fact that none of his criminal cases will conclude before November. It is possible that one or several of his criminal cases could be concluded by Election Day. There is no doubt that some of these prosecutions have been brought to try and knock Trump off of the ballot or at least damage his campaign. And some look more like a Hail Mary political prosecution than an ordinary criminal case. But Trump faces serious risks of conviction in some of them.

The Constitution does not prohibit a prisoner from running or winning the presidential election. It is not surprising that the framers of the Constitution did not account for this possibility. They did not expect the American electorate to make such a selection. So, let’s consider what would occur if Trump was both…
