Missouri’s attempt to stop Biden’s administration from “jawboning”, or threatening social media companies, has reached Supreme Court. The Solicitor-General filed a lengthy brief explaining why cert should have been granted and asking for a stay on the Fifth Circuit injunction. The Court granted cert as well as the stay.
The SG brief was notable for its innovative approach in addressing the legal issues of the case. First, it declared that states such as Missouri do not have a right under the first amendment to hear their citizens’ opinions. Later, the SG had to resurrect a right very similar to a first-amendment right for the federal governments to speak to their citizens. Confused? You need not worry.
